Investigators sometimes know when a lawyer is working behind the scenes during an investigation, but not always. Two lawyers, one representing employee-plaintiffs, the other representing employer-defendants, let you peek behind the curtain and into their thought-processes, advice to clients, and the strategies they use with their clients during your investigations. Focusing on different scenarios, these lawyers will provide you with a point-counterpoint discussion of (1) what their clients might say or do during your investigation as a result of their advice, (2) what they want to happen during the investigation in order to bolster their cases at trial, and (3) how you can best navigate their shark-infested waters to get the information you need to properly conclude your investigation.

Denise K. Drake represents management in employment lawsuits, including collective, multi-plaintiff and multi-defendant employment actions, as well as in arbitration and mediation. She has obtained jury verdicts on behalf of management in cases involving sexual harassment, race discrimination, disability discrimination, age discrimination, and retaliation.  Ms. Drake has also successfully obtained dismissal or summary judgment (upheld on appeal when challenged) in many cases filed across the nation. She has successfully defeated nationwide certification of several wage and hour collective actions; convinced plaintiffs to voluntarily dismiss approximately 30 actions; and advantageously used offers of judgment, questionnaires and other strategic tools to appropriately position cases for efficient and successful resolution.

Lori Deem

Lori Deem is a partner with Outten & Golden LLP in Chicago, Illinois.  She represents employees/plaintiffs exclusively in employment matters, including negotiation and litigation in the areas of employment discrimination, sexual harassment, retaliation, FMLA, and related employment torts, as well as drafting and negotiating employment contracts, separation agreements, and non-compete agreements. She is the Employee Administrative Chair of the Employment Rights and Responsibilities Committee (ERR) of the Labor & Employment Section of the American Bar Association (ABA).
