Issuing confidentiality admonitions has long been the standard practice for investigators. Then came the NLRB’s Banner decision and, well, things changed dramatically as the Board imposed considerable restrictions on using confidentiality admonitions during investigations. In June 2015, the NLRB reaffirmed its opinion in Banner, but the dilemmas remain on how to craft lawful, confidentiality admonitions.  This fast-paced presentation will review the current state of the law and provide you tips, tools and a practical approach in the quest to keep information learned in the course of investigation and other aspects of the investigation confidential.
