California’s recent adoption of mandatory supervisor training on abusive conduct is requiring in-house counsel, attorneys, and Human Resource professionals to review how allegations of bullying are investigated.  Outside of California, investigators deal with bullying as well, as that term is usually defined through internal policies.  Through the use of role-playing and vignettes, the presenters will analyze workplace scenarios to identify whether “abusive conduct,” as defined by the Fair Employment and Housing Act, has occurred and assess whether the alleged conduct meets the definition of bullying. The presenters will also discuss how case law has provided a context for what can be considered “abusive conduct.” 

Learning Objectives:

  • Learn to identify “abusive conduct” as defined by the FEHA through role-playing scenarios.
  • Identify best practices for investigating claims of workplace bullying inside and outside of California.
  • Understand training methods that will assist managers in identifying workplace bullying.
  • Learn how case law has provided a context for what will and will not likely be considered to be workplace bullying.

Tammy Brown 

Tammy Brown has twenty years of experience as a civil litigator as well as several years of investigating HR matters for an international defense contractor. She leads Foster Employment Law's investigative practice.

Her practice also emphasizes the defense of employment-related claims in federal and state courts and administrative agencies, including defending class action claims for failure to provide breaks and to pay proper overtime rates; defending race, gender, and disability discrimination cases; arguing cases before the California Courts of Appeal on the enforceability of arbitration agreements; and representing clients in matters before the Labor Commissioner and defending Labor Code section 132a claims. In addition to her active labor and employment litigation practice, Tammy has litigated a range of business disputes involving general business contracts, construction contract disputes, claims brought by government agencies, and fraud disputes. She has represented both private and public employers in a broad array of local and national industries.
