This popular, fast-paced, interactive program is designed to introduce the participants to the theory and the practical skills necessary to conduct impartial investigations of allegations of employee misconduct. Among other things, you will learn how to: ask effective questions, interview reluctant witnesses, obtain relevant evidence, assess credibility, and arrive at a legally defensible decision. You will also learn how to prepare and utilize all of the necessary documentation during the investigative process. Each attendee will receive program materials containing valuable checklists, forms, and templates that will assist them in carrying out investigations. The seminar runs from 9 am to 4 pm and includes continental breakfast and lunch. Previous sessions of this seminar have sold out, so register now to secure your place.

Presenters

Jennifer A. DoughtyJennifer A. Doughty is a Senior Associate Attorney with Van Dermyden Maddux Law Corporation. Jennifer graduated from Santa Clara University School of Law in 2002 and earned an undergraduate degree from Duke University in 1997.      

Jennifer’s practice focuses on investigations involving the workplace, athletic teams, and Title IX complaints. Jennifer conducts investigations relating to harassment, discrimination, retaliation, and misconduct. She also conducts trainings for staff and management on how to conduct effective workplace investigations. Jennifer also has experience in employment litigation and client counseling. Trained in Trauma Informed Forensic Interviewing, Jennifer is an experienced investigator in Title IX sexual misconduct and harassment claims. She has investigated cases involving University faculty and administrators, underage complainants, multiple respondents, and complex issues involving incapacitation and consent. Jennifer also serves as an Appeal Hearing Officer for Title IX cases. In this role, Jennifer reviews campus investigations and responses to Title IX allegations, within the framework of the individual school’s appeal process. As an Appeal Hearing Officer, Jennifer has handled cases involving sexual assault, sexual harassment, dating violence, incapacitation, and inability to consent. Jennifer is admitted to practice before the courts of the State of California and the Federal District Courts of the Northern, Southern, and Eastern Districts of California. In 2012, she received a Certificate of Completion from the Association of Workplace Investigators Institute. Jennifer began her legal career as a litigator in Mobile, Alabama, where she defended premises liability actions for international retail companies. She has also been admitted to practice before the 11th Circuit Court of Appeal, the 5th Circuit Court of Appeal, and all state and federal courts of Alabama and Mississippi.


Beth WestBeth West is a shareholder at Weintraub Tobin and is the Chair of the Firm’s Labor and Employment Group. She is admitted to practice law in California and Washington and has years of experience counseling and defending employers in all areas of employment law. Her practice focuses on counseling and training employers, human resource professionals, and management staff on laws relating to hiring; performance improvement; disciplinary actions; privacy; terminations and lay-offs; employment policies and contracts; protection of trade secrets; wage and hour laws; leaves of absence and accommodation laws; discrimination, harassment and retaliation; and compliance with other state and federal employment laws. Beth also has extensive experience defending employers in various forms of employment-related litigation in state and federal court, and in administrative actions before a number of state and federal agencies.  In addition to her employment practice, Beth serves as a neutral  and independent workplace investigator for private companies and public agencies. She is a charter and sustaining member of the Association of Workplace Investigators (AWI) and has passed the rigorous AWI exam to obtain a certificate in workplace investigations.  Also, with her years of experience as an employment attorney and her specialized training and certification from Cornell University's ILR School in employment mediation, Beth provides trusted and effective mediation services to resolve various employment-related disputes.
